These Terms & Conditions ("Terms") govern your use of this website and the Safety Roadmap report (the "Roadmap") provided by SecuraHaul ("SecuraHaul", "we", "us"). By submitting the request form, or by receiving or using a Roadmap, you agree to these Terms on behalf of yourself and the motor carrier you represent. If you do not agree, do not submit the form and do not use the Roadmap.
What the Roadmap is
The Roadmap is an informational report prepared from publicly available Federal Motor Carrier Safety Administration ("FMCSA") data associated with the USDOT number you submit, together with general industry practice. It summarizes that public data, groups it, and suggests actions a carrier may wish to consider.
What the Roadmap is not
- It is not legal advice, and it does not create an attorney-client relationship.
- It is not regulatory, compliance, safety, insurance, tax or financial advice, and it does not create a consultant, advisor or fiduciary relationship.
- It is not an audit, inspection, certification, or compliance review, and it is not endorsed by, affiliated with, or reviewed by FMCSA or any other government agency.
- It is not a substitute for advice from a qualified attorney or safety professional familiar with your specific operation.
No guarantee of results
Requesting, receiving, or acting on a Roadmap does not guarantee any outcome. Without limitation, we make no representation or promise regarding the result of any DOT audit, compliance review, safety investigation, roadside inspection, enforcement action, rating, CSA or SMS BASIC measure or percentile, insurance premium, claim, or litigation. Safety outcomes depend on facts and decisions outside our control.
Source data, estimates and accuracy
The Roadmap relies on third-party public data that we do not create or control. That data may be incomplete, delayed, mis-coded, or inaccurate, and it changes over time. In particular:
- FMCSA does not publish official percentile ranks in its public files. Any percentile shown in a Roadmap is SecuraHaul's own estimate, calculated as described in the report's method notes, and it may differ from FMCSA's official figures.
- Each Roadmap is a snapshot tied to the data snapshot dates stated in the report. It may be out of date the moment the underlying data refreshes.
- Public FMCSA data does not identify individual drivers. Nothing in a Roadmap attributes a violation to a named person.
- Regulations change. We make no representation that a Roadmap reflects current requirements or covers every requirement applicable to your operation.
The Roadmap is provided for general informational purposes only, and you should independently verify any figure before relying on it.
Your compliance obligations remain yours
You remain solely responsible for your own regulatory compliance, safety program, equipment condition, driver qualification, recordkeeping, and all decisions affecting your operation. Nothing in a Roadmap, on this website, or in any communication from us transfers, assumes, or shares that responsibility, and nothing here creates any duty on our part to identify, report, or correct any condition.
Your authority to request a Roadmap
By submitting the form you represent and warrant that you are at least 18 years old, that the contact details you provide are accurate and your own or your employer's, and that you are authorized by the motor carrier associated with the USDOT number you submit to request this report on its behalf. Do not submit a USDOT number belonging to a carrier you are not authorized to represent.
Use of the Roadmap
- We grant you a limited, non-exclusive, non-transferable license to use the Roadmap internally within your own company.
- You may not resell, sublicense, republish, or redistribute the Roadmap, or present it as your own work or as a certification of compliance.
- You may not use the Roadmap, or any figure in it, to make representations to third parties about your safety standing or compliance status.
- You may not use this site or the Roadmap to evaluate, market to, or disparage another carrier, or for any unlawful purpose.
- The Roadmap, this website, and their content, structure, methodology and design remain the property of SecuraHaul.
Use in disputes or proceedings
The Roadmap is not prepared for use as evidence, as an expert opinion, or in any litigation, arbitration, audit, insurance, underwriting or regulatory proceeding, and it should not be offered or relied on for that purpose. We have no obligation to testify, produce records, or provide support in connection with any such matter.
Availability of the service
We provide the Roadmap at no charge and at our discretion. We may decline any request, limit the number of requests, modify or discontinue the service, or change what a Roadmap includes, at any time and without notice. We do not promise any delivery time; any timeframe mentioned on this site is an estimate, not a commitment.
Disclaimer of warranties
THIS WEBSITE AND THE ROADMAP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TITLE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DATA OR FIGURE IS ACCURATE, CURRENT OR COMPLETE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECURAHAUL AND ITS OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS OR AUTHORITY, LOSS OF DATA, INCREASED INSURANCE COSTS, FINES, PENALTIES, CIVIL PENALTIES, JUDGMENTS, SETTLEMENTS, OR AUDIT, ENFORCEMENT OR LITIGATION OUTCOMES, ARISING OUT OF OR RELATING TO THIS WEBSITE OR THE ROADMAP, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE THE ROADMAP IS PROVIDED AT NO CHARGE, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THIS WEBSITE OR THE ROADMAP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify, defend and hold harmless SecuraHaul and its officers, employees and contractors from and against any claims, demands, losses, liabilities, damages, fines, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of this website or a Roadmap; your breach of these Terms; your submission of a USDOT number you were not authorized to submit; your representations to any third party based on a Roadmap; or your own regulatory compliance, safety practices, or operations.
Third-party sites and data
This site references and relies on third-party sources, including FMCSA and its published datasets, and may link to third-party websites. We do not control and are not responsible for third-party content, data, availability, or practices.
Governing law and venue
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms, this website, or a Roadmap will be brought exclusively in the state or federal courts located in Illinois, and you consent to personal jurisdiction and venue there. Any claim must be brought within one (1) year after it arises.
Changes to these Terms
We may update these Terms at any time. The date at the top of this page shows when they were last revised. Your continued use of this website, or your use of a Roadmap after a revision, means you accept the updated Terms.
Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and SecuraHaul regarding this website and the Roadmap. Our failure to enforce any provision is not a waiver of it.
